Who Should Form a US Company?

A US LLC is worth considering if any of the following apply to your situation: you sell products or services to US customers; you need a Stripe or PayPal account that processes US payments without friction; you want to invoice clients in USD from a recognized US business entity; you plan to raise capital from US-based investors; or you receive US-source income and have a US tax reporting requirement.

Forming a US LLC does not automatically create US tax liability. A foreign-owned, single-member LLC with no US-connected income and no US employees is typically treated as a disregarded entity for US federal income tax purposes. This is a significant advantage. ITIN processing takes 7 to 11 weeks from the date the IRS receives the complete application. During peak filing season, which the IRS defines as January through April, processing can reach the upper end of that range. We recommend submitting at least 12 weeks before a deadline you need the ITIN to meet. The IRS mails the assigned number to the address on your Form W-7. There is no online status tracker. You can call the IRS international line at 267-941-1000 for a status update after 7 weeks have passed.
